An Unfortunate Truth



Michael Cohen’s expected testimony today will be be both explosive and divisive. The fissure will fall largely along partisan lines. I need not address those issues.
My concern is the incalculable damage done to the legal profession and the rights of our clients in this process.
If a lawyer can be compelled or even permitted to proclaim his client’s confidential information to the whole world, why will any client be safe in the future?
The rule of confidentiality belongs to clients not lawyers. And if you want your rights protected you need to have the confidence that your lawyer cannot be pressured or permitted to flip on you and reveal your confidential conversations.
The rights of average Americans will take a big hit today.
