Unprotected Speech

There are basically nine categories of un-protected speech under the first amendment:

- Obscenity
- Fighting words
- Defamation (including libel and slander)
- Child pornography
- Perjury
- Blackmail
- Incitement to imminent lawless action
- True threats
- Solicitations to commit crimes

Some experts also would add treason, if committed verbally, to that list. Plagiarism of copyrighted material is also not protected.

Under item #7 of the above list, Rep. Maxine Waters is being called by some to resign because of her address calling for citizens to rise up against President Trump and members of his administration and of his supporters.
